Trial and Arbitration
  • Lead counsel representing car dealerships in two-week trial against Zurich North America Insurance in which jury found for dealerships on contract, fraud, and business tort claims and awarded $5MM in compensatory damages and $6MM in punitive damages.
  • Lead counsel for food business alleging trade secret, breach of fiduciary, and breach of contract claims in federal court in Virginia against shareholders aligned with the Chinese government. After repeated successes in the litigation, client was able to settle the case on wholly favorable terms.

  • Lead counsel for national contractor defending arbitration claims alleging millions in lost profits relating a proposed nuclear power plant project. Client prevailed on all claims.

  • Lead counsel for bank defending against breach of contract and tort claims relating to construction project in Texas. Jury found in favor of client bank on all counts. Court awarded sanctions against opposing counsel.
  • Lead attorney for hospital in significant internal investigation stemming from broad allegations of wrongdoing by hospital executives.
  • Lead counsel for municipality in litigation with irrigation district with over $100 million dollars in environmental and infrastructure costs at issue. Success on interlocutory appeal and at trial allowed municipality to prevail.
  • Lead counsel for one of the largest energy companies in the world in high profile litigation brought by environmental group seeking to block transportation of refinery equipment and related construction project. Trial, appellate, and administrative victories allowed client energy company to save hundreds of jobs and avoid millions in potential losses.
  • Lead counsel in breach of contract and business tort action arising out of custom manufacturing relationship with Nokia. Client achieved recovery in excess of $13 million.

  • Lead counsel for wood treatment facility in environmental clean- up litigation brought Idaho Department of Environmental Quality. Case resolved with client avoiding clean up costs and with clean up burden imposed on different owner responsible for contamination.
  • Served as national trial counsel for leading building materials manufacturer in product liability, toxic tort, and professional negligence cases.
  • Lead counsel for Snake River Dairyman Association defending against tort and contract claims alleging in excess of $15 million in damages. Client prevailed on all claims after multi-week arbitration.

Class Actions
  • Lead trial counsel for defendant software company in class action case in federal court in Michigan involving product liability and allegations of constitutional violations.

  • Lead trial counsel for defendant software manufacturer in class action in federal court in Washington involving allegations that software violates state laws prohibiting gambling.

  • Co-lead trial counsel for defendant manufacturing facility in six- week toxic tort class action trial in Louisiana. Plaintiffs asserted claims in excess of $100 million. Jury found in favor of client defendants on all counts.
