We will review the pending tax legislation and discuss planning opportunities that clients and their advisors should be considering.

Litigating Federal Gift and Estate Tax Disputes
Speaker: Rich Kiely
This presentation will cover the key issues that arise during the course of litigating a federal gift and estate tax dispute, including procedural steps, evidentiary burdens, and gift and estate tax doctrines arising in Federal Tax Court.

The Digital Frontier (In Estate Planning) is Here: Remote Online Notarizations and Electronic Wills

In the three week span of December 31, 2020 through January 21, 2021, new Colorado laws became effective to provide for both remote online notarization and electronic wills.

UTC Part 5/Wyoming DAPT
Speaker: Carol Warnick
Colorado passed the Uniform Trust Code (UTC) several years ago but declined at the time to pass Part 5. The legislature recently dealt with Part 5 which addresses the validity of spendthrift provisions and creditor’s rights, among other things.

Wyoming has a domestic asset protection trust statute and is becoming more widely utilized as an asset protection jurisdiction.

Trust Situs Considerations
Speaker: Rebecca Schroer
We will review considerations for choice of trust situs, including asset protection, income tax, trustee duties, beneficiary rights and ease of administration. We will also discuss mechanisms to accomplish situs goals, including change of situs, use of directed trustee arrangements and use of private family trust companies.
