Join Holland & Hart LLP for a complimentary Labor & Employment Law Update Breakfast Briefing on The EEOC's Guidance on Religious Discrimination and the New ADA Amendments Act of 2008.
Every employer needs to be prepared to recognize and address the issues arising from the passage of the Americans with Disabilities Amendment Act of 2008 (ADAAA) and from the EEOC's new compliance guidance regarding religious discrimination under Title VII.
The new ADAAA, which will take effect January 1, 2009, reverses several U.S. Supreme Court decisions related to the interpretation of the ADA, expands the definition of what "major life activities" are when deciding whether an employee has a qualifying disability, and rejects the impact of most "mitigating measures," thereby making it far easier for employees to seek protection and rights under the ADA.
Religious discrimination claims against employers have surged in the past several years. In July, 2008, the EEOC issued new guidelines to help employers accommodate employees' religious rights while keeping their business running.
Join us to learn about current litigation trends and how you can adopt policies and procedures to avoid the potential for increased legal liability arising from employee claims of religious discrimination and ADAAA related discrimination.
This briefing for General Counsel and HR professionals will cover:
1. The New ADA's Expanded Definition of "Disability" and How It May Be Applied
2. The Impact of the New ADAAA on "Mitigating Measures"
3. Defining and Accommodating Religious Belief Under Title VII
4. Employer Conduct That Could Constitute Unlawful Discrimination Under Title VII
5. Recommendations, Policies and Procedures to Avoid Costly Mistakes and Litigation
A question and answer session will follow.
