  • Rescheduling: Will he/won’t he—President Trump may make a move; new DEA Administrator Terrance Cole says it’s a top priority.

  • New Markets: TX to issue new compassionate use program licenses. KY to open first medical dispensary this fall.

  • In the Courts: Missouri Supreme Court strikes down cannabis tax “stacking.” Second Circuit finds NY’s cannabis licensing priority for NY-only convicted applicants is unauthorized “economic protectionism.” 

  • 280E challenges: New Mexico Top Organics v. Commissioner briefs due in Tax Court this fall;  Canna Provisions and other marijuana companies get more time from US Supreme Court to seek review of Gonzales v. Raich.    

  • Hemp Regulation: TX to consider hemp products in new special session. New rules proposed in AL (consumable hemp products) and TN proposed (HDC products)

  • Policy Updates: CO releases proposed rules to improve regulatory efficiencies; CA auditor recommends legislature review youth advertising.
