Roaring Fork Wind Closes Sale of Maverick Creek Wind Project

Holland & Hart served as lead counsel to Roaring Fork Wind, LLC (Roaring Fork), a joint venture between subsidiaries of Renewable Energy Systems Americas Inc. and Vestas Wind Systems A/S, in the sale of the Maverick Creek Wind Project (Maverick Project), an approximately 480 MW (AC) wind electric generating facility under development in Concho County, Texas.

During the development of the Maverick Project, Holland & Hart advised on issues arising as to the qualification of the Maverick Project for production tax credits. In connection with the sale, the firm also assisted Roaring Fork with internal restructuring, as well as establishing a joint venture with the purchaser of the Maverick Project. Additionally, Holland & Hart represented RES (Construction), LP (a subsidiary of Renewable Energy Systems Americas Inc.) in the negotiation of a Balance of Plant Engineering, Procurement, and Construction Agreement for the Maverick Project.

The Holland & Hart electric power transactional team was led by Denver-based partner Ashley Wald, with assistance from Adam Cohen, Paige Coriden, Todd Criger, Mike Dill, Sarah Haradon, Kit LeVoy, Kenyon Redfoot, and Nick Venetz.
