Playing Smart And Getting The Most Out Of The Bid Protest Process: A Practical Guide For Federal Government Contractors - Colorado Springs

A fundamental principle of the federal procurement system is that all bidders must be treated fairly and equally in the government's evaluation and award of its contracts. Where a bidder feels that it has been treated unequally or unfairly in the competition for a government contract, that bidder has the right to file a bid protest challenging the solicitation or the government's evaluation and award determination.

Shrinking government discretionary budgets and fewer available government business opportunities have made the bid protest process a more important business tool than ever for government contractors. That tool has been used more frequently over the past few years as the number of protests has continued to rise. It is important, therefore, for government contractors to have a comprehensive understanding of the bid protest process so that they can utilize the process to its maximum advantage.

This 90-minute presentation is provided by highly experienced Holland & Hart bid protest attorneys, and will address key issues that government contractors should consider when deciding whether to initiate and how best to pursue or defend against a bid protest, including:

  • Pre-award vs. post-award bid protests
  • Timeliness and other jurisdictional traps
  • How to get the most out of contractor debriefings
  • Pros and cons of the available bid protest fora (Agency, GAO, Court of Federal Claims)
  • Awardee intervention in bid protests
  • Protective orders
  • Successful and unsuccessful protest grounds
  • Remedies, including corrective action, settlement and re-evaluation
