Significant changes in the Clean Water Act regulatory framework are afoot. This session will provide an overview of the Clean Water Act changes most relevant to the regulated community, including:

  • Ongoing Waters of the United States (WOTUS) rulemaking and litigation
  • EPA's forthcoming rules and guidance on state water quality certifications under section 401
  • Changes to the section 404 program
  • Ongoing litigation—now before the U.S. Supreme Court—over which waters are subject to Clean Water Act requirements
