New Substance Use Disorder Confidentiality Rules

The Substance Abuse and Mental Health Services Administration (SAMHSA) has finally issued its long-anticipated regulations that modify privacy rules for federally assisted substance use disorder programs under 42 CFR part 2.  The SAMHSA fact sheet is available on the Health and Human Services website at Fact Sheet 42 CFR Part 2 Final Rule.  In this webinar, Kim Stanger will discuss the new rules and how they coordinate with HIPAA, including:

  • Which entities are covered by the rules.
  • Relaxed consent standards.
  • Modified rules concerning disclosures to third parties.
  • HIPAA sanctions that replace criminal penalties.
