Idaho’s new Medical Ethics Defense Act protects providers who decline to participate in treatment that conflicts with their conscience; however, the law also adds a broader, more concerning whistleblower private cause of action that extends beyond conscience situations to any allegation of a violation of law, regulation, or ethical guidelines or “gross mismanagement, … waste of funds, … abuse of authority, or … danger to public health or safety.” Successful employees or other plaintiffs may recover reinstatement, damages, costs and fees.
