Holland & Hart Elects Four New Partners
DENVER (January 5, 2006) - Holland & Hart LLP is pleased to announce that Rick D. Bailey, Bryan K. Benard, Steven M. Gutierrez, and Christopher L. Thomas were admitted to the firm partnership on January 1, 2006.

Mr. Bailey is a trial attorney who focuses on complex business disputes. Matters recently handled by Mr. Bailey include disputes relating to trade secrets, fiduciary duties, competition law, large vendor contracts and regulatory requirements. Prior to joining Holland & Hart, Mr. Bailey was the Senior Vice President and General Counsel for AT&T Broadband, which was the largest cable television and broadband company in the United States at the time. Mr. Bailey held various other senior positions for AT&T Corp., including Vice President of Federal Government Affairs, where he was responsible for the day-to-day operations of AT&T’s federal government affairs office in Washington, D.C. Prior to joining AT&T, Mr. Bailey was a trial attorney in private practice in Chicago, IL.

Mr. Benard's principal areas of practice include labor and employment counseling and litigation, commercial litigation, and civil appellate matters in the Salt Lake City office. He regularly represents both private and public clients in wrongful termination, harassment, and discrimination claims in both federal and state courts, as well as in administrative proceedings before federal and state agencies. Mr. Benard counsels clients regarding employee relations, employee contracts, and employee handbooks. He also represents employers in matters related to the Family and Medical Leave Act, the Uniformed Services Employment and Re-employment Rights Act, the Americans with Disabilities Act, and the Fair Labor Standards Act, including administrative investigations into wage and hour complaints.

Mr. Gutierrez works out of the Denver and Colorado Springs offices as a member of Holland & Hart's labor and employment practice group. He regularly advises private employers regarding policies and practices relating to employment relationships. He has extensive experience addressing claims concerning wrongful termination, breach of express or implied employment contracts, violation of covenants not to compete, contracts for the protection of trade secrets, employment discrimination, wage matters including FLSA and FMLA claims, defamation, torts and claims of retaliatory discharge. He also handles ERISA litigation matters.

Mr. Thomas has extensive experience in employment-based immigration law and manages the firm’s immigration practice from the Denver office. He advises and represents companies in the preparation of employment-based nonimmigrant petitions, labor certification applications, immigrant petitions, and adjustment of status and consular processing applications. He guides corporate clients through I-9 verification procedures and helps them in anticipation of DHS and DOL audits and criminal investigations. He also completes family-based petitions and naturalization applications.
