Providers are often caught between HIPAA and other judicial or law enforcement officers demanding patient information. Police, prosecutors, or other attorneys often do not understand HIPAA or appreciate the penalties that providers face for improper disclosures; consequently, they often provide misinformation or make misguided threats against providers who are simply trying to comply with applicable rules. This program will:
- Review HIPAA rules and exceptions for disclosures to per subpoenas, court orders, warrants, or law enforcement demands.
- Summarize common state laws that require or allow disclosures.
- Provide practical guidance for responding to orders, subpoenas, or law enforcement requests.
- Give participants documents that they can use when responding to such orders or requests.
