Fake News and the Reality of Juror Decision Making – Making Persuasion Pertinent and Permanent in 2018

New Orleans

In today's environment, jurors have instantaneous access to news and information. While this may suggest jurors are more fact-focused than ever before, research suggests there are some important questions about how today's jurors are processing information. Namely, jurors today are increasingly reliant on their personal opinions and beliefs than on facts. And for litigators this means that even in the face of strong factual evidence supporting your client's position, your jurors may be resistant to your case. In this presentation Senior Litigation Consultants share trends, observations, and unique research data that illuminate today's climate for litigants. Psychological barriers to persuasion are discussed and successful strategies for overcoming fact-resistance, concerns about fake news, and those sticky persistent beliefs that can derail an otherwise solid case are presented.
