U.S. employers submitted over 70,000 PERM labor certification applications to the Department of Labor (DOL) last year to assist immigrant workers in obtaining green cards. The PERM process is the first of three major steps in getting permanent residency (the green card) and has the highest rates of denials. The DOL typically conducts audits on 33% of all PERM applications and denies approximately 13% of all submissions. Because the PERM process can often lead to audits, denials, supervised recruitment, and other challenges, we will discuss:

  • Frequent reasons for PERM certification denial
  • Best practices to minimize errors and denials
  • How to appeal decisions through a Motion for Reconsideration or Review
  • Successful arguments in reversing denials
  • Trends in administrative appeals
