Our attorneys have substantial experience in broad aspects of residential and multifamily real estate development, from mitigation of construction defect litigation, land and title due diligence investigation, land acquisition documentation, infrastructure financing and overcoming obstacles, water supply and water right solutions, and entitlements.

We advise clients in the negotiation, drafting, and review of infrastructure and vertical construction, design, and consultant contracts to limit potential liability. We process governmental real estate division approvals, and prepare sales agreements and disclosure documents in compliance with local, state, and federal requirements. In addition, our role includes assistance regarding real estate project loans for the developer/builders acquisition and metro district and public financing for public improvements.

Our real estate lawyers are very knowledgeable about zoning, entitlements and subdivisions for projects, and development and annexation agreements between the developer/builders and the local governmental entities concerning the development process. Every day, we handle matters involving the creation and operation of common interest communities, as well as issues concerning homeowners' and condominium associations. Additionally, we are involved in green building and legislation affecting builders and developers.

Representative residential developments range from condominium projects, fractional interest projects, condominium conversions, low-income senior housing projects, to some of the largest residential single and multifamily developments in the country. Our practice group is a dominant force in this area of the law.

  • Represent public and private homebuilding companies in all aspects of acquisition, entitlement, construction and development for more than 40 projects along the Front Range.

  • Outside general counsel for several of the largest master-planned communities in Colorado from acquisition and entitlement through sales of lots to homebuilders.

  • Counsel to the developer and owner of Summerlin, one of the largest masterplanned communities in the nation.

  • Counsel to the developer in connection with the construction of a 74 unit, low-income senior apartment complex and a related construction and permanent mortgage loan.

  • Counsel to the developer in connection with the construction of an 88 unit, low-income senior apartment complex, and a related construction and permanent mortgage loan.
  • Counsel to investor group in connection with the acquisition and restructuring of a premier Colorado golf course and related facilities.

  • Assist developer with acquisition and development of an 103-acre in-fill parcel near Littleton, Colorado.

  • Represented master developer of 275-acre residential community in Aurora, Colorado, from acquisition, entitlement, public improvement financing, and sale of lots to homebuilders.

  • Represented owner in private equity financing for private detached and multi-family builder.

  • Involved in a number of public-private partnership agreements, including the publicly funded construction by a private developer of a $200 million public wastewater project for a mixed-use project.

  • Lobbied on behalf of the Colorado BUILDS and NAIOP as to real estate development, construction defect reform, and homebuilder legislation.

  • Prepared forms to be used across the country for vertical and land construction contracts and retail sales disclosures for national and local homebuilders.
