Alison Wente analyzes real property in high-end resort communities, providing legal strategy in the purchase, sale, ownership, operation, development, re-development, and conservation of land and water. 

She is an Aspen native, knows the Aspen community well, and serves on the boards of several local non-profit organizations. Alison has written regulations for local municipalities and routinely advises clients on local codes. She is well-versed in the technical components of title to real property, leasing, purchase and sale contracts, development agreements, subdivision improvement agreements, and the Colorado Common Interest Ownership Act (CCIOA). In addition, Alison counsels clients through the transactional aspects of acquiring or selling water rights in Colorado.

Alison represents the gamut of lenders, investors, developers, businesses, municipalities, homeowners’ associations, and individual clients.

Water and Land Use Law Emphasis:  Alison holds a Master of Laws in water law and land use/zoning law from the University of Denver. Prior to joining the firm, she was a legal intern at the Colorado Water Conservation Board (focused on Colorado water law) and the Rocky Mountain Institute (focused on land use law).

Residential and Commercial Real Estate
  • Represented sellers and buyers in negotiating and closing on numerous complex residential and commercial real estate transactions valuing upwards of $15 million.

  • Secured land use approvals from Pitkin County, drafted conservation easement, and negotiated agreements with neighbors to facilitate development and conservation of large rural property.

  • Negotiated and closed the sale of a partial ownership interest in a development company.

  • Analyzed development potential, procured, and sold transfer of development rights (TDRs) for landowners, investors, and developers.

  • Successfully reduced real estate property tax valuations for upper end residential properties.

  • Served as lender’s counsel to close on a deed in lieu of foreclosure.

  • Secured water rights in water court for municipalities, golf course developments, and individuals.

  • Served as borrower’s counsel to refinance loan on commercial property.

Resort Development
  • Represented industry group in negotiations to locate and develop telecommunications facilities on ski resorts.

  • Represented developers in purchase and sale agreement, neighborhood outreach, and securing entitlements for large-scale mixed-use development.

  • Drafted complex governing documents for high-end fractional ownership interest community.

Land Use & Zoning
  • Analyzed land use and zoning entitlements on behalf of lender for construction loan to fund large-scale development projects.

  • Represented applicant in procuring local and state license to open operate bar and restaurant.

  • Drafted marijuana licensing, marijuana taxation, and general land use ordinances and regulations for various municipalities.
