EXPERIENCE

Mr. Martinez is a litigator with a practice that spans Holland & Hart's Government Investigations & White Collar Defense, Commercial Litigation, and Privacy & Data Security practice groups. As a part of his practice, Mr. Martinez's focuses on three areas: organizational privacy and data security, election and campaign finance law, and commercial litigation.

In the data security side of his practice, Mr. Martinez has experience advising clients on a broad spectrum of privacy and information security issues; including Internet anonymity, identity theft, "pretexting," website spoofing, privacy policies, and the associated state and federal laws that regulate this specialty area. Mr. Martinez commonly responds to businesses that are victims of network "hacking" and other "cybercrimes," or suffer lost or stolen laptops holding sensitive information. Prior to his tenure at Holland & Hart, Mr. Martinez learned to speak the language of data security by designing and building web-based data systems for emerging businesses in the information technology field.

Another aspect of Mr. Martinez's practice takes place at the intersection of law and politics. His current clients include elected officials, political action committees, and businesses impacted by special elections. Mr. Martinez regularly represents clients on election law and campaign finance matters before federal, state and administrative courts in Colorado, as well as election commissions, title boards and local clerks and recorders.

Mr. Martinez's election law experience is grounded in his professional political experience. Some examples of Mr. Martinez's prior engagements include: creating and managing the Hispanic Vote Project; serving as the interim executive director of the Colorado Democratic Party; and crafting the boundaries for Colorado's congressional and legislative districts.

In the commercial litigation side of his practice, Mr. Martinez has represented both plaintiffs and defendants in cases involving asset purchases, sales contracts, computer software licensing agreements, partnership agreements, and in various other commercial and business tort contexts.

Outside of the law firm, Mr. Martinez continues to remain active in the community as a member of the Board of Directors for the Bell Policy Center and as a motivational speaker at local schools. Most recently, Mr. Martinez took a short leave from the law firm to serve on the Obama-Biden Presidential Transition Team where he worked with both the technical and legal teams regarding transparency and ethics in the federal government.

Mr. Martinez is admitted to practice in Colorado.
