EXPERIENCE

Mr. Feldewert is a certified specialist in natural resources, oil and gas law, by the Board of Legal Specialization of the New Mexico State Bar and is listed by Southwest Super Lawyers (2008 and 2009) in the areas of Energy & Natural Resources.

Energy, Natural Resources and Tax Litigation

Mr. Feldewert has over 15 years of experience representing energy companies in proceedings involving the New Mexico Oil Conservation Division/Commission, the New Mexico Taxation and Revenue Department and the New Mexico State Land Office.  Mr. Feldewert has handled complex commercial litigation and class actions in both state and federal courts, including the following cases:

Elliott Industries v. BP Amoco Production Company, 407 F.3d 1091 (10th Cir. 2005)  - Denial of class certification and affirming judgment in favor of defendants on royalty underpayment claims for conventional natural gas production in the San Juan Basin of New Mexico.

Arnaldo and Gina Valenzuela v. Baker Hughes, Inc., CV-2001-366, Fifth Judicial District Court (August 2003) -  Mr. Feldewert was lead counsel in a week-long jury trial in Carlsbad, New Mexico, during which he successfully defended Baker Hughes against a personal injury claim arising out of a well site accident.

Martinez v. New Mexico Environment Department, 133 N.M. 472, 64 P.3d 499 (N.M. App. 2002)  - Reversing a landfill permit granted by the New Mexico Environment Department.

San Juan 1990-A., L.P.  v. El Paso Production Company, Meridian Oil, Inc., Blackwood & Nichols Co., Devon Energy Corporation, Amoco Production Company, and John Doe, 43 P.3d 1083 (N.M. App. 2002)  - Denial of class certification and entry of judgment in favor of the defendants on royalty underpayment claims for coalbed methane gas produced in the San Juan Basin of New Mexico.

Creson v. Amoco Production Company, 10 P.3d 853 (N.M. App. 2000) - Upholding judgment in favor of defendants on royalty underpayment claims for carbon dioxide gas produced from the million-acre Bravo Dome Carbon Dioxide Gas Unit in New Mexico.

Waggoner v. Amoco Production Company, 1999 U.S. App. LEXIS 3416 (10th Cir. 1999)  - Affirming dismissal of claims brought by landowners alleging contamination of water supplies from natural gas wells.

Blackwood & Nichols v. New Mexico Taxation and Revenue Department, 964 P.2d 137 (N.M. App. 1998) - Addressing the incidence of tax under a prior version of the Natural Gas Processors Tax Act.

Meridian Oil, Inc. v. New Mexico Taxation and Revenue Department, 921 P.2d 327 (N.M. App. 1996)  - Reversing an administrative determination involving the confidentiality of a tax audit report.

Team Bank v. Meridian Oil Inc., 879 P.2d 779 (N.M. 1994) - Establishing the proper venue for disputes over natural gas royalty payments.

Amoco Production Company v. New Mexico Taxation and Revenue Department, 878 P.2d 1021 (N.M. App. 1994) - Addressing the proper calculation of interest for late payment of oil and gas production taxes.

Meridian Oil, Inc. v. New Mexico Taxation and Revenue Department, 921 P.2d 327 (N.M. App. 1996) - Reversing an administrative determination involving the confidentiality of a tax audit report.
