Brian Kinnear focuses on patent prosecution, counseling, licensing, and litigation. His technical experience ranges from sophisticated and complex communication and biomedical devices to cutting edge improvements in recreational activities associated with sports equipment and UV protection. Currently, Mr. Kinnear's practice focuses on patent prosecution and counseling for his clients, although he is frequently called on to consult in all phases of litigation including assisting in all aspects of discovery and claim interpretation in the federal court. He is adept at weighing the risks of litigation against the cost and advising clients on approaches to maximize the economics, but minimize the costs. In that regard, Mr. Kinnear has researched and prepared numerous infringement, validity, and freedom to operate opinions.
While Mr. Kinnear is frequently called on by his clients for advice regarding specific intellectual property matters, he also assists clients mange diverse and worldwide patent portfolios. The management typically includes developing adequate protection for technology in the United States and analyzing whether and where to protect inventions around the world.
Prior to beginning his legal career, Mr. Kinnear worked as practicing engineer. He worked with the Department of Defense on upgrading the nuclear power plant for Los Angeles class submarines (including the U.S.S. Dallas made famous by the movie and book "The Hunt for Red October") as a nuclear test engineer for the Department of defense at Portsmouth Naval Shipyard. Mr. Kinnear also worked as an instrumentation and control engineer for ABB Impell corporation, which was a subsidiary of ABB (Asea Brown Boveri Ltd.)
Law Week Colorado's third annual Barrister's Best edition named Mr. Kinnear "Best Patent Lawyer" as voted by the People's Court in 2009.

Mr. Kinnear's clients range from Fortune 100 corporations to very small companies. He has prepared and prosecuted patent applications for clients on artificial intelligence, satellite imaging, medical devices, complex fractal encoding and decoding, and a plethora of business methods. In short, Mr. Kinnear has substantial experience working in a wide range of industries and with a wide range of technologies.
Mr. Kinnear's prosecution practice also ranges to the international field. This includes representing foreign clients in front of the United States Patent and Trademark Office, as well as assisting United States clients obtain foreign patent protection.
Patent Litigation
Mr. Kinnear has been involved in many patent infringement lawsuits on behalf of both plaintiffs and defendants. In these cases, he is generally responsible for developing the patent strategy of the trial, including all aspects of claim interpretation and developing patent infringement, validity and enforcement positions. Mr. Kinnear's cases have involved diverse products such as computer software, garbage cans, recycling systems, caller id and digital answering machines, portable canopies and outdoor sports equipment.
Engineering
Prior to attending law school, Mr. Kinnear was a practicing engineer for approximately five years. He has worked on Los Angeles Class Submarines (including the U.S.S.
