Mr. Andersen has practiced law at Holland & Hart for 28 years. He represents both plaintiffs and defendants in complex litigation. He has tried to verdict more than 50 civil cases in federal and state courts throughout his home jurisdiction and other states. A recent publication profiling Mr. Andersen describes him as "formidable in everything he does" and having "a real presence in the courtroom." He has tried cases involving partnership dissolutions, patents, intellectual property, medical malpractice, personal injury, product defect cases, governmental liability, agriculture, royalties, professional liability, insurance bad faith, banking bad faith, disputed inventorship, engineering, and construction disputes.
Mr. Andersen is admitted to practice before all state and federal courts for Idaho. He has argued numerous appeals before the Idaho appellate courts, the Ninth Circuit Court of Appeals, and is admitted to the Federal Circuit.
Mr. Andersen has been in private practice since 1982 and a partner with Holland & Hart since 1987. He was Managing Partner of Holland & Hart's Boise Office for the years 1995-2003. Intellectual Property Litigation
Mr. Andersen has experience in intellectual property litigation including trial to successful verdict cases involving claims of disputed inventorship, defense of patent infringement, prosecution of patent infringement including jury verdicts for willful infringement, defense of trade dress claims, Lanham Act violations, antitrust and patent misuse issues, trade secret violations, Computer Fraud and Abuse Act claims. Mr. Andersen has never lost an intellectual property case at trial. These cases have included a wide range of products, devices, and methods such as technology for potato sprout inhibition, sonar devices, bioassay devices, smoke protection devices, software infringement, and identity theft.

Contingency and Alternative Fee Arrangements
Mr. Andersen typically represents defendants in commercial disputes. However, he maintains a practice for carefully selected, deserving plaintiffs in the areas of complex products liability (such as tire failures, seatbelt designs, and food contamination), premises liability (such as road design, bridge failure, dram shop), medical devices, aircraft defects, medical negligence, lender liability, federal tort claims, agriculture, insurance bad faith, and business torts. He obtained Idaho's largest affirmed personal injury verdict of $7.8 million and recently obtained a $56 million verdict for a defective agricultural chemical. He has obtained 10 verdicts in excess of $1 million and several dozen settlements of the same magnitude.
Holland & Hart has a small standing committee to evaluate and approve contingency fee cases and alternative fee cases. Mr. Andersen has sat on that committee for the last 15 years. He has extensive experience representing institutional clients and industries on an alternative fee basis such as fixed fees, mixed fees that blends contingent and hourly components, and fee arrangements with low rates plus benchmark payments and incentives.
