Mr. Smith has been one of the leading bankruptcy and insolvency lawyers in Colorado for over 25 years. During that time, he has represented creditors in virtually all types of bankruptcy cases, with a focus on Chapter 11 reorganizations but with a wealth of experience in Chapters 7, 9, 12 and 13 cases as well. While focusing primarily on the creditors' side, he has also represented debtors in Chapter 11 cases. He has represented numerous buyers and sellers of assets in Chapter 7 and 11 cases, including significant acquisitions in contested and competitive bidding situations. Mr. Smith's bankruptcy cases have covered almost every conceivable type of business, from mining to retail, agriculture to high tech, special districts to airlines, and many more. He has been involved in most of the major Chapter 11 cases filed in Colorado and many elsewhere, as well as a multitude of the moderately sized business bankruptcies that are common in Colorado. He has extensive experience in bankruptcy litigation of nearly all types in a wide range of cases.
Aside from his bankruptcy practice, Mr. Smith is experienced in out-of-court workouts, state court receiverships, and a variety of other insolvency and creditors' rights matters. He is also a commercial litigator and trial lawyer, having handled many cases in the Colorado state and federal courts. He is admitted to practice before the state and federal courts in Colorado, as well as the U.S. Courts of Appeals for the 9th and 10th Circuits and the U.S. Supreme Court.
As an established member of the Denver legal community, Mr. Smith has long-standing working relationships with virtually all of the bankruptcy practitioners with whom he deals. He has also worked hard to maintain a reputation of integrity and credibility with the bankruptcy judges in the district, many of whom he has known for many years.
