EXPERIENCE

Mr. Phillips has practiced environmental law and litigation for more than 25 years. His experience includes EPA enforcement actions under the Clean Air Act, RCRA, and the Clean Water Act (including storm water, NPDES and Section 404); representing companies in Superfund proceedings; overseeing Environmental Impact Statements for new projects; and preparing detailed analyses outlining state and federal environmental laws and regulations applicable to new projects and acquisitions. Mr. Phillips has represented national energy and resources trade organizations in rule making and litigation before U.S. EPA and the D.C. Circuit Court of Appeals. He has often represented companies in soil and groundwater contamination cases and "toxic tort" cases.

From 2003 to 2007, Mr. Phillips served as the Chair of Holland & Hart's Management Committee, overseeing substantial growth in the firm to more than 375 lawyers in seven states and the District of Columbia. Previously, he served as Chair of the firm's Resources Department and Practice Manager of its Environmental Group.

Mr. Phillips is listed in The Best Lawyers in America and Who's Who in America. In 2004, the Colorado Bar voted Mr. Phillips the top Natural Resources/Environmental lawyer in the Denver Business Journal's "Best of the Bar" Survey. He is admitted to practice before the U.S. Supreme Court, the 9th, 10th and D.C. Circuit Courts of Appeal and various other courts.

PUBLICATIONS AND SPEAKING ENGAGEMENTS

Mr. Phillips has published extensively in both legal and technical periodicals. He wrote The Technical Basis for a Thoracic Particulate Matter Standard and an article in the Colorado Real Estate Journal titled "Pollution Lawsuits Among Private Parties." Mr. Phillips authored a paper on the National Environmental Policy Act, titled "NEPA and Alternative Energy: Wind as a Case Study," in the Solar Law Reporter. Mr. Phillips has taught courses on various aspects of environmental law, including criminal environmental law, and the Rocky Mountain Mineral Law Foundation's short course on Management of Hazardous Substances. He also helped author the Environmental Law Title of the first and second edition of the American Law of Mining.
